Terms of Purchase

Thank you for shopping at marshallphoto.com (this “Website”). Before you complete this transaction, we need your agreement to the following terms and conditions governing the purchase of the items in your shopping cart.

All photographic images found on this Website are the copyrighted property of Jim Marshall, unless otherwise indicated. As such, these photographic images may not be copied, distributed, publicly displayed, or otherwise reproduced without Mr. Marshall’s express written authorization. Please note that, in purchasing a print or other reproduction of an image from this Website, you acquire only the print or reproduction itself for personal, noncommercial purposes, and not any intellectual property right belonging to the copyright owner of the image (e.g., the right to reproduce, publicly distribute, or publicly display the image). You agree to indemnify Groovy Collectibles LLC and/or Jim Marshall for any losses, damages, costs, expenses, or fees they incur as a result of your breach of these terms.

Return and Cancellation

All sales are final, and no returns shall be accepted. This policy is necessitated by the fact that almost all of the items sold on this website are rare, one-of-a-kind collectibles and/or signed or otherwise made to order. For the same reason, we shall not accept cancellation of any orders.

Delivery

We strive to securely pack our prints and other collectibles and for them to arrive safely into your possession. In the case of a lost package, we will file a claim with our shipper and will replace the item as quickly as possible. Please note that some items are one of a kind and not replaceable. In that case you can replace the lost item with one of equal value, or we can refund your card for all charges.

If your item is damaged in shipping, and such damage is obvious when you receive the package, you should refuse to accept delivery of the package and contact us immediately. If you do accept the package, and upon opening it, observe any damage to the item(s) enclosed, please contact us immediately as per the information noted above.

Warranty

Jim Marshall and Groovy Collectibles LLC expressly disclaim all warranties of any kind, express, implied, or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, with regard to any item you purchase on the Website. In no event will Groovy Collectibles LLC or Mr. Marshall be liable for any damages whatsoever, including, but not limited to any direct, incidental, consequential, special, exemplary or other indirect damages arising out of (i) the use of or inability to use the Website, (ii) any transaction conducted through this Website; (iii) any claim attributable to errors, omissions, or other inaccuracies in the Website, (iv) any item purchased from this Website, or (v) any other matter relating to the Website. In purchasing from this Website, you agree to hold Jim Marshall and Groovy Collectibles LLC harmless for any losses, damages, costs, expenses, or fees you incur as a result of this or any other purchase from this Website.

Dispute Resolution

You agree that, in all legal disputes that arise from your purchase from or your use of this Website, you will submit to the jurisdiction of the State of California. You further agree that any such legal dispute may be venued in San Francisco, California.

Amendments

No amendment or variation of any of the terms or provisions of this purchase agreement shall be valid unless made in writing and executed by all parties.

Severability

In the event any provision of this agreement shall be held to be invalid or unenforceable by a Court, such provision shall be enforced as nearly as possible in accordance with the intentions of the parties in entering into this agreement, and the legality, validity or enforceability of the remaining portions of the agreement shall not be affected.
